Terms of Service

Agreement

These Terms are the agreement between you and the company named in "Who operates Formly" below. Creating an account or using the app means you accept them; if you do not accept them, do not use Formly.

We can revise these Terms. Formly sends no push notifications, so the posted text is the notice: the current version is always in the app under Profile → Support → Terms of Service, and the date at the end changes when we revise it. For a change that materially affects your rights we will also email the address on your account. Continuing to use Formly after a revision is posted means you accept it.

What Formly does

Formly analyzes sports and gym movement with AI. You submit a photo or a video and get back a scored report: a summary, what you are doing well, what to work on first, drills, and a goal for your next session. The Progress tab tracks your scores over time. Groups lets you join an optional challenge, or publish individual checks to a private club of people you train with and write simple workout plans for it.

• Form checks send your photo or video clip through our servers or directly to temporary storage at Google's AI for analysis. Google is the only AI provider Formly uses. Clips are not stored on our servers after analysis. For video checks, Formly may keep a device-local copy so you can replay the clip beside the saved report on that device.
• The activity travels with the media. This version of the app has no way to choose one: if an earlier version recorded a sport for you, that is the label Formly sends with every form check, and if it did not, the label is "Any activity".
• Clubs are private and opt-in twice over — you join one with a code, and then publish individual checks to it one at a time. Nothing you make is published anywhere by default. "Groups and shared checks" below sets out what the other members receive and what you can do about someone who misuses it.
• Form checks need your permission first. Before your first one, Formly asks you to allow the media and text you submit to be sent to Google, and remembers your answer for that account on that device. Decline and form checks stay off; the rest of the app still works.
• There is no switch to turn that permission back off. Today the only things that stop future sends are declining in the first place, deleting Formly from your device, or deleting your account, which stops that account being able to make requests at all. Emailing us cannot clear it — the record sits on your phone, not on our servers — and anything already sent cannot be recalled. We would rather tell you that than describe a button that does not exist.
• We can add, change or remove features. These Terms cover Formly as it is on the day you use it.

Formly is not a doctor or a coach

Everything Formly produces is educational information, not medical advice. A form check is a model watching the clip you send, or reading the photo. It does not replace a doctor, or a coach who can watch you move in person. The output is generated automatically and can be wrong, incomplete, or a poor fit for your body and your sport, including when it sounds confident. Scores, technique judgments and drill suggestions are starting points for your own thinking, not instructions to follow without question. Consult a doctor or a certified coach before you start or change a training program, particularly if you are injured, in pain, or managing a medical condition. Training carries a risk of injury, and you accept that risk when you act on anything Formly tells you. Stop if something hurts. If you think you have a medical emergency, call your local emergency number.

Who can use Formly

Formly is for adults only. You must be at least 18, meet any higher minimum age required where you live, and be able to enter a binding agreement. Parental permission does not make someone under 18 eligible. You may use Formly only in countries and territories supported by the Gemini API (https://ai.google.dev/gemini-api/docs/available-regions). We limit App Store distribution accordingly. Account setup requires an explicit confirmation of this minimum age and acceptance of these Terms. We save the minimum age confirmed, the Terms version and the completion time with your account. A previous confirmation under our former 13+ policy does not satisfy this requirement; existing users must confirm the new eligibility before using the service. This is self-declaration: we do not collect your date of birth or independently verify your age. If you believe someone under 18 has created an account, email contact@formlyai.app so we can investigate and delete the ineligible account.

Your account

An account is for one person. Give accurate details when you create it, keep your password to yourself, and email contact@formlyai.app promptly if you believe someone else has access. You are responsible for everything done under your login. If you sign in with Apple or with Google, whoever controls that account controls your Formly account.

Your email address is how we reach you and how you get back in if you forget your password. It is shown read-only under Personal information on your Profile tab — you cannot change it in the app, so email contact@formlyai.app if it needs updating.

Your content

Your photos, video clips and the note you type remain yours. You give Formly permission to do one thing with them: run the service you asked for, and keep it working and secure. That covers transmitting what you submit through our servers or directly to temporary storage at Google so its AI can respond, storing the generated results and your note in your account so you can return to them, keeping a local replay copy of a video check on your own device when available, and the routine backups, security work and abuse investigation needed to operate the service. It goes no further. We do not sell your content, use it to advertise to you, or use it to train models. Small media passes through our servers in memory and is not stored there. Large videos upload directly to temporary Google storage. We request deletion after the check or cancellation; interrupted uploads may remain with Google for up to 48 hours.

One thing you can ask us to do beyond that, and only you: publish a finished check to a group you are in, which shows it to the other members of that group and nobody else. That permission is per check, you give it by switching the check on for that group, and switching it off withdraws it.

Health information is worth being exact about. The optional "Anything to focus on?" note is saved alongside the result — so if you type that your knee hurts, that sentence is stored until you delete it. If you put health information there, you are explicitly consenting to us storing and processing it so the analysis can use it; in the EEA and the UK that explicit consent under Article 9(2)(a) GDPR is the only basis on which we handle it. It is separable and it is reversible. Leave the note blank and there is no health data to process at all. Deleting an individual form check removes its note and any replay copy on that device, and deleting your account removes all of it.

Groups and shared checks

A club is private. You create one, or join with an invite code somebody gives you. There is no directory, no public search, and no way to find a club you were not invited to. A club holds up to 40 people, and you can be in ten clubs at once.

Challenges are separate from clubs. Every signed-in athlete can see the same published challenge catalogue. Joining one stores your membership and lets Formly calculate your progress from your own form checks during its dates. Other athletes see only the total number of people who joined, never your identity or your individual progress. You can leave at any time.

Publishing is per check and off by default. A form check reaches a club only when you switch it on for that specific check, and switching it off removes it again — the other members lose access at that moment. Nobody sees checks you have not published, and neither does the person who created the club.

What the club receives is the display name you set for Groups, the score, the activity, the date, and the written report: the summary, the strengths, the improvements, the drills and the next-session goal. Your video and your photo are never shared with a club. Temporary processing storage and any device-local replay copy are separate from the group report. Two things are worth knowing before you publish. The optional "Anything to focus on?" note is part of the stored check and travels with it, so leave it out of a check you intend to publish if you would rather keep it to yourself. And deleting a check afterwards is not the same as taking it down: the report goes, but the score, your display name and the date stay with the club. Take it down from the club first — one tap — and the club's copy is gone.

Your best published score each week is kept per club for the weekly board, as a high-water mark. Taking a check down does not lower it, and leaving the club does not clear it; otherwise leaving and rejoining would be a one-tap way to erase a week. Deleting your account clears it.

Anyone in a club can write a workout plan for it: a title, an optional note, and up to twenty exercises with a short line of detail each. Everyone in the club can read it, and any member can attach a check to an exercise on it — but only a check they have already published to that club, so attaching publishes nothing new, and taking the check down removes it from the plan in the same moment. You can delete a plan you wrote, and the club's owner can delete any of them.

Creating a club makes you its owner. You can remove any member, remove any published check, delete any workout plan, and delete the club. If you leave, or delete your account, the club is handed to its longest-standing remaining member rather than destroyed, and it is deleted only when the last person leaves. Owning a club gives you no access to anything a member has not published.

Do not publish a check of someone else without their permission. If a clip you analysed shows another person, that person's permission is yours to get, and if they are under 18 that means their parent or guardian. Do not publish anything you would not be willing to show that person.

There is no tolerance here for abusive behaviour or objectionable content. Every published check carries a "More" control, and pressing and holding the check does the same thing: report it, block the person who published it, or — if it is yours, or the club is yours — remove it. A workout plan carries the same three actions on the plan itself. We review every report within 24 hours and remove content, remove the person from the club, or end the account behind it where these Terms have been broken. Blocking takes effect immediately and works in both directions: you stop seeing their checks, their workout plans and their place on the board, and they stop seeing yours. They are not told. This version of the app has no unblock control, so email contact@formlyai.app if you want a block lifted. We can remove anything published through Formly, or end an account, where we believe these Terms have been broken — and we will tell you why unless we are legally unable to.

Our intellectual property

The app itself belongs to Formly or its licensors: the software, the name, the logo, the design, and the instructions behind the analysis. These Terms give you a personal, non-exclusive, non-transferable, revocable licence to use Formly on Apple-branded products that you own or control, as the Usage Rules in the App Store Terms of Service permit, or on an Android device you own or control. It does not extend to devices you do not own or control, except where those Usage Rules allow it. You get no rights to our trademarks or proprietary systems, and no right to copy how the product works underneath.

Your privacy and your rights over your data

What Formly collects, what it deliberately does not, who receives it and how to get it deleted are set out in the Privacy Policy, which you can open from the Support section of your Profile tab. It is part of this agreement. These are the points that change what you can ask of us.

• Why we are allowed to process your data. In the EEA and the UK we rely on performing this contract for everything the app needs to run, on our legitimate interest in keeping it secure and working, on your explicit consent under Article 9(2)(a) for health information you volunteer in the note, and on legal obligations where one applies.
• What you can ask for. Access to your data and a copy of it, correction, deletion, restriction, portability, and objection to anything we process on legitimate interests. Where we rely on your consent you can withdraw it, and the limits of that for the AI permission are described above rather than dressed up. Email contact@formlyai.app, or delete the account yourself from the bottom of the Profile tab.
• Complaining about us. If you are in the EEA, the UK or Switzerland you can lodge a complaint with your data protection authority — the ICO in the UK, your national supervisory authority elsewhere. We would rather hear from you first at contact@formlyai.app, but you do not have to contact us before complaining.
• Where your data goes. Formly's providers are in the United States, so running a form check transfers your data there. Supabase hosts the database and passes AI requests through, Google generates form checks, RevenueCat holds your subscription status, and Apple or Google handles billing. For users in the EEA, the UK and Switzerland we rely on the European Commission's Standard Contractual Clauses, or on an adequacy decision or the EU-US Data Privacy Framework where the provider is certified. Ask at contact@formlyai.app for a copy of the safeguards we rely on.
• California. You can ask for the categories and the specific pieces of personal information we hold, ask us to delete or correct it, and ask us to limit how we use sensitive personal information — which for Formly means anything about your health you typed into the note. We do not sell personal information and we do not share it for cross-context behavioural advertising, as California law defines those terms. We will not treat you differently for exercising any of these rights. Make a request at contact@formlyai.app, yourself or through an authorised agent; we verify it against your account email before acting.
• Google Sign-In and location. Formly never asks iOS for your location and stores none. If you sign in with Google, Google's own sign-in library may derive a coarse location from your connection as part of that sign-in. That happens under Google's privacy policy, not ours, and it is not sent to Formly. Signing in with Apple or with an email address avoids it entirely.
• People under 18. Formly is for adults only and does not permit accounts for people under 18. Tell us at contact@formlyai.app and we will delete the account and its data.

Acceptable use

Do not:

• Submit photos or video of another person without their permission
• Submit sexual or nude content, or images of a child
• Submit content that is illegal, abusive, or that you do not have the right to use
• Harass, bully, threaten or impersonate another member of a group, or publish anything to a group that the people in it would find objectionable
• Reverse engineer, scrape, overload or attack the app, our servers, or the services we depend on
• Work around the usage limits, the paywall or any security control, including opening extra accounts to collect more free form checks
• Treat Formly as a diagnostic tool, or use it in place of emergency care

If your use causes us a claim

If someone brings a claim against Formly because of content you submitted or because you broke these Terms, you agree to cover the reasonable costs and damages we incur as a result, so far as the law of your country allows. We will tell you promptly about any such claim and will not settle it without talking to you first.

Who operates Formly

Formly is operated by Adrien Bodson, 4041 avenue Marcil, Montréal, Québec H4A 2Z7, Canada. Questions, complaints and claims about the app can be sent to that address, or by email to contact@formlyai.app.

Usage limits

Form checks are metered, on the free tier and on Pro alike. The limits are enforced on our servers, so they apply regardless of what the app on your phone shows.

• Free: one successful form check per identity. Deleting an account and registering again with the same email identity does not grant another free check; email aliases may count as the same identity.
• Pro: 100 form checks per UTC calendar month. Paid subscriptions also have a limit of 25 analysis requests per 24-hour window; the 3-day trial has a limit of 6 per 24-hour window. Each daily window begins with its first counted request. The monthly allowance resets at the start of each UTC month and does not carry over. Shorter rate limits also protect the service from bursts of requests.
• If a form check fails, we put the credit back. If the credit cannot be returned automatically the app says so on the spot rather than reassuring you; email contact@formlyai.app and we will restore it by hand.

Subscriptions and billing

Formly Pro is the only paid tier. It is sold in two plans, monthly and annual, through the Apple App Store or Google Play. The price you will pay is shown in the app before you confirm. Apple or Google charges your store account at confirmation of purchase, and Formly never receives or handles your card details.

Pro renews automatically for the same period, at the then-current price, until you cancel. Your store account is charged for the renewal within 24 hours before the current period ends, so cancel at least 24 hours before that point or you will be charged for the next period. Turn auto-renewal off in your store account settings, or through the Formly Pro card at the top of your Profile tab, which opens them. Cancelling stops the next charge and leaves you with Pro until the period you have already paid for runs out.

Refunds are handled by Apple or Google under their own policies, and they take the payment, so we cannot issue a refund or reverse a store charge ourselves. That does not affect any statutory right of withdrawal, refund or remedy you have under the consumer law of your own country — if you have one and the store will not honour it, write to contact@formlyai.app.

Deleting your Formly account does not cancel your subscription. Cancel in the store first, or you keep paying for an account that no longer exists.

We can change prices where the law permits, with reasonable notice, and a new price applies from your next renewal rather than to a period you have already paid for.

The free trial

The annual plan includes a 3-day free trial. The monthly plan has none. The store decides eligibility, so if you have already used a Formly introductory offer you will not be offered another. The app shows the trial to anyone it cannot rule out in advance, which means you may see "Start 3-day free trial" and then find the store's purchase sheet offering no trial. That sheet states what you will actually be charged, and it is the one that binds.

A trial becomes a paid annual subscription unless you cancel it at least 24 hours before it ends — with three days, that means cancelling by the end of day two. Cancel in your device's subscription settings. The store applies that cutoff, not Formly.

No warranties

Formly is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the app will be available without interruption, that an analysis will succeed, or that anything the AI tells you is accurate. Some countries do not allow these exclusions; where that is so, this section applies only as far as the law there permits.

Limits on our liability

To the maximum extent the law allows, Formly and its affiliates are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost goodwill arising from your use of the app. Where liability cannot be excluded, our total liability to you is limited to the amount you paid for Formly in the twelve months before the claim arose. Nothing in these Terms limits liability that the law does not allow us to limit, including liability for death or personal injury caused by negligence, or for fraud.

Ending the agreement

You can stop using Formly whenever you like. Delete account, at the bottom of the Profile tab, permanently erases your profile, your preferences, your stats and your form checks from our database. It also takes you out of every group, with every check you published to one and your rows on its weekly board; a group you created is handed to its longest-standing remaining member rather than destroyed. It cannot be undone. It does not clear the app's own storage on your device, and it does not cancel your subscription. We can suspend or close an account that breaches these Terms, that is being used to harm someone, or where the law requires it. When this agreement ends, your right to use the app ends with it. The sections meant to outlive it do: Formly is not a doctor or a coach, Your content, Our intellectual property, Acceptable use, If your use causes us a claim, No warranties, Limits on our liability, Governing law, and The rest of the agreement.

Apple App Store terms

If you obtained Formly from the Apple App Store, the following applies and prevails over anything above that conflicts with it.

• These Terms are between you and Formly only, not with Apple. Formly, not Apple, is solely responsible for the app and its content.
• The licence granted under "Our intellectual property" is limited to use on Apple-branded products you own or control, as the Usage Rules in the App Store Terms of Service permit.
• Apple has no obligation to provide any maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
• Formly, not Apple, is responsible for addressing any claim relating to the app, including product liability, failure to conform to legal requirements, and consumer protection or privacy claims.
• Formly, not Apple, is responsible for investigating and resolving any third-party claim that the app infringes intellectual property rights.
• You must comply with any applicable third-party terms when using Formly, including the usage policies of the AI provider that processes what you submit.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as terrorist-supporting, and that you are not on any U.S. Government prohibited or restricted party list.
• Questions, complaints and claims about the app should be directed to Formly at the name and address given in "Who operates Formly" above, or to contact@formlyai.app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Governing law

These Terms are governed by the law of the jurisdiction identified in "Who operates Formly" above, and its courts have jurisdiction over any dispute arising from them. If you are a consumer resident somewhere else, nothing here removes the protection of the mandatory consumer law of your country of residence, or any right that law gives you to bring a claim where you live.

The rest of the agreement

If any part of these Terms is found unenforceable, that part is narrowed or removed to the minimum extent needed and the rest stays in force. Not enforcing a provision is not a waiver of it. These Terms and the Privacy Policy are the whole agreement between us about Formly, and they replace anything said about it beforehand. You cannot transfer your rights under them. We can transfer ours to a successor if the business is sold, on notice to you and without reducing the rights you have here. Before starting formal proceedings, write to contact@formlyai.app and we will try to settle it directly — you do not have to wait for us, and this takes nothing away from your right to go to a regulator or a court.
